NFG Pay (“we,” “our,” or “us”) provides its software services through its website located at nfg-pay.com and related mobile applications and products (collectively the “Services” or “NFG Pay”). Before using our Services, please read the Terms of Service (the “Terms”) carefully, along with any other policies or notices on our website or mobile applications.

AGREEMENT TO TERMS

By accessing or using any or all of the Services, you expressly acknowledge that (i) you have read and understood these Terms; (ii) you agree to be bound by these Terms; and (iii) you are legally competent to enter into these Terms. If you do not agree to be bound by these Terms or any updates or modifications to these Terms, you may not access or use our Services. WE DO NOT PROVIDE INVESTMENT OR FINANCIAL ADVICE OR CONSULTING SERVICES. WE ARE SOLELY THE PROVIDER OF NFG PAY AND DO NOT ADVISE OR MAKE RECOMMENDATIONS ABOUT ENGAGING IN DIGITAL ASSET TRANSACTIONS OR OPERATIONS. Decisions to engage in transactions or perform operations involving digital assets should be taken on your own accord.

You acknowledge and agree that your use of the Services is subject to, and that we can collect, use, and/or disclose your information (including any personal data you provide to us) in accordance with our Privacy Policy.

UPDATES TO TERMS OR SERVICES

We reserve the right to update or modify these Terms at any time at our sole discretion. If we do so, we’ll let you know by either posting the revised Terms on our website, on our mobile application, or through other methods of communication which we deem reasonable. Such revised Terms as posted will take effect immediately unless otherwise indicated. If you continue to use NFG Pay following any update or modification of the Terms, you shall be deemed to have accepted the revised Terms. If you do not agree to the Terms or any update or modification to the Terms, you must cease to access or use our Services.

ELIGIBILITY

To be eligible to use NFG Pay:

You must be at least eighteen (18) years old and legally competent to enter into these Terms.
You must not be a resident of sanctioned jurisdictions where Visa, Mastercard, SWIFT, or other payment networks block transactions (e.g., Russia).
You can only use our Services if permitted under the laws of your jurisdiction. For the avoidance of doubt, you may not use our Services if you are located in, or a citizen or resident of, any jurisdiction where your use of our Services would be illegal or otherwise violate applicable laws.

You agree that you are only using our Services with legally obtained funds that rightfully belong to you. By using NFG Pay, you represent and warrant that you meet all eligibility requirements outlined in these Terms. We may refuse to let certain people access or use NFG Pay and reserve the right to change eligibility criteria at any time.

SERVICES

NFG Pay is a custodial wallet, banking, and payment processing software for digital assets such as cryptocurrencies and fiat currencies. You are solely in control of and responsible for your Digital Assets and can authorize transactions from your wallet address. You expressly acknowledge and agree that NFG Pay is a custodial wallet, banking, and payment processing software, and you are solely responsible for your activity and any risk of loss at all times.

NFG Pay allows you to:

Generate wallet addresses and associated private keys to send and receive digital assets.
Receive payments through our payment gateway.
Use third-party providers to process SEPA, SWIFT, Credit Card, Apple Pay, Google Pay, and numerous local payment methods based on country and currency.
Broadcast Digital Asset Transaction data to blockchains supported by NFG Pay without requiring you to download or install associated blockchain-based software to your local device.

Digital Asset Transactions

In order for all proposed Digital Asset transactions to be completed, they must be confirmed and recorded on the associated public blockchain. Such networks are decentralized, peer-to-peer networks supported by independent third parties, which we do not own, control, or operate. We cannot influence blockchain networks and are not responsible for delays, failures, or errors caused by them. However, you can find detailed information on respective blockchain issues via their official pages.

By using NFG Pay, you acknowledge and agree that:

We do not have the ability to cancel or otherwise modify your transaction.
Transaction details you submit may not be completed or may be substantially delayed by the applicable blockchain networks.
Any transfer in relation to Digital Assets occurs on the relevant blockchain network and not on a network owned by us. We do not guarantee the transfer of title or rights in any Digital Asset.

PAYMENT AND FEES

NFG Pay integrates with various third-party payment methods, including Visa, Mastercard, Apple Pay, Google Pay, SEPA, SWIFT, and local payment processors. Users must comply with the terms of these third-party providers.

We use REST APIs and provide callbacks that connect with your IPN URL, along with a secret key for encryption. However, NFG Pay does not endorse third-party services and assumes no responsibility for any issues arising from their performance.

THIRD-PARTY SERVICES AND CONTENT

FORCE MAJEURE

We shall not be held liable for delays, failures in performance, or interruptions in service resulting from circumstances beyond our reasonable control. These include, but are not limited to:

Acts of God
Acts of civil or military authorities
Acts of terrorism
Labor disputes
Changes in blockchain protocols or network failures

We do not control blockchain networks or their performance and will not be liable for any losses related to blockchain issues. Users can find additional information on blockchain performance and issues via the respective blockchain’s official website or support.

INTELLECTUAL PROPERTY

As long as you comply with these Terms, we grant you a non-exclusive, non-sublicensable, and non-transferable license to use NFG Pay for personal or internal business purposes. Any misuse of the software, including reverse engineering, distribution, or using it for competitive analysis, is strictly prohibited. Clients actively using NFG Pay services may link to our website under certain conditions outlined in the full Terms.
